NOTICE TO TAXPAYERS AND ALL OTHER PERSONS AFFECTED OF PUBLIC HEARING CONCERNING A PROPOSED LEASE BETWEEN THE TOWN OF SHIPSHEWANA REDEVELOPMENT AUTHORITY AND THE TOWN OF SHIPSHEWANA REDEVELOPMENT COMMISSION
Taxpayers of the Town of Shipshewana Redevelopment District (“Redevelopment District”) and all other persons affected hereby are notified that on June 5, 2025, the Redevelopment Commission of the Town of Shipshewana, Indiana (the “Commission”) will hold a public hearing upon a proposed lease (the “Lease”) to be entered into between the Town of Shipshewana Redevelopment Authority, as lessor, and the Commission, as lessee, with respect to the leasing of certain roads within the Redevelopment District to enable the financing of the costs of the planning, designing and construction of certain improvements and extensions to the Town’s sewage works (the “Project”). The proposed Lease will have a term no longer than twenty-five (25) years. The maximum annual lease rental to be paid by the Commission under the proposed Lease will not exceed $200,000. Lease rentals under the proposed Lease will be payable from food and beverage tax revenues received by the Town pursuant to Indiana Code 6-9-27. The proposed Lease further provides for terms concerning the use, maintenance, repair, operating and utility costs, insurance, destruction of the premises, defaults, remedies, options to purchase and miscellaneous other matters. The public hearing will be held at 4:00 p.m., Eastern Standard Time, at the Shipshewana Town Hall, Rodger D Yoder Room, 345 North Morton, Street Shipshewana, IN 46565. All interested parties will be provided the opportunity be heard at the hearing. After the public hearing, which may be adjourned from time to time, the Commission may adopt a resolution authorizing the execution of the proposed Lease on behalf of the Town, if it finds that the service to be provided throughout the term of the proposed Lease will serve the public purposes of the Town and it is in the best of interests of the Town’s residents and that the lease rental provided for is fair and reasonable. The proposed Lease is open to public inspection in the Clerk-Treasurer’s office of the Shipshewana Town Hall, 345 N Morton Street Shipshewana, IN 46565.
